CSOs’ advocacy leads to the vote of the law on public hygiene in Benin

The Consultation Framework of Non-State Actors in the Water and Sanitation Sector (CANEA) has succeeded in its advocacy, which began in 2013 and was strengthened in 2020 and 2021, thanks to the technical and financial support of NIYEL, with the vote by the National Assembly of Law No. 2022-04, on public hygiene in the Republic of Benin. Voted on Thursday 20 January 2022, this law replaces the old hygiene code dating from 1987.

The advocacy process, led by CANEA, which is led by CWP Benin, helped the drafting of the bill by the members of the Beninese Network of Parliamentarians for Water and Sanitation (RBPEA). On 30 October 2021, the bill was forwarded by deputies Gildas AGONKAN and Jérémie ADOMAHOU, members of RBPEA.

The new law, which comprises one hundred and ninety-seven (197) articles, divided into five (05) titles, takes into account and completes the provisions of the 1987 law on public hygiene in accordance with the current realities and challenges of Beninese society in terms of hygiene and sanitation. While the first title deals with general provisions, title II deals with public hygiene rules, while title III deals with pollution and nuisances. Title IV deals with penal provisions and finally Title V deals with transitional and final provisions.

As innovations, this law specifies the role of decentralized communities in the promotion of hygiene, the issues of hygiene of public buildings, establishments of different levels of education, the hygiene of sanitary establishments, detention centers, the management of corpses and the management of menstrual hygiene.

For the civil society, this act taken by the deputies of the 8th legislature, under the leadership of its chair, is to be welcomed and honors them. CANEA is pleased with this progress and only awaits the promulgation of the law for its popularization, but also, the adoption of texts for its application as the deputies also wished.
